SafeWork NSW has issued new enforceable undertakings guidelines. 

The authority’s Enforceable Undertakings Guidelines outline the approach for considering an offer of an enforceable undertaking (EU) from a person who has allegedly committed an offence against the WHS Act.

These guidelines have been updated following extensive consultation with the private sector, and address key recommendations from the recent evaluation of the EU program.

The new guidelines should provide a clearer process for the consideration of a person’s compliance history with work health and safety laws or other regulatory schemes; their attitude and commitment; and their capability to develop and deliver on an EU.

The revised guidelines have also been amalgamated with the former EU Customer Service Standard into one concise publication.
